Introduction

Welcome to XALTED Exclusive Experiences. By using our services, you agree to be bound by these Terms & Conditions.

These terms govern your use of our services and establish the legal relationship between you ("Client") and PT XALTED Exclusive Experiences ("Company"). If you do not agree with these terms, you should not proceed with booking our services.

Definitions

"Company" refers to PT XALTED Exclusive Experiences.
"Client" refers to any individual or entity booking services from XALTED Exclusive Experiences.
"Services" refers to all services provided by the Company.

Booking & Payments

All bookings are subject to availability and are confirmed only upon full payment.
Payments are processed through Xendit, a secure third-party payment gateway.
Clients agree to Xendit’s payment terms and policies when processing a transaction.
The Company does not store or process credit card information directly.
Any additional bank or transaction fees imposed by the payment provider are the responsibility of the Client.
All prices are exclusive of applicable government taxes (PPN 11%) and any service fees, unless explicitly stated otherwise.

No Refund Policy (Cancellations & Returns)

All sales are final and non-refundable. Once a booking is confirmed, no refunds, cancellations, or modifications will be allowed.
If the Client cancels a booking for any reason, no refund or credit will be issued.
In case of a no-show or late arrival, the service will be considered delivered, and no compensation will be provided.
The Company is not responsible for delays, interruptions, or cancellations due to force majeure events.
In exceptional cases, the Company may allow rescheduling at its sole discretion, subject to availability

Chargebacks & Disputes

By using our services, the Client agrees not to initiate chargebacks with their bank or payment provider without first contacting the Company.
Any disputes regarding payments must be addressed through Xendit’s dispute resolution process.
If a chargeback is filed fraudulently or without valid cause, the Company reserves the right to take legal action to recover funds and associated costs.

Service Modifications & Disputes

The Company reserves the right to modify or reschedule services due to operational, security, or regulatory reasons.
Clients may request a reschedule under exceptional circumstances, subject to approval and availability.

Client Responsibilities

Clients are responsible for:

Providing accurate and complete information during booking.
Complying with local laws and regulations while using our services.
Not causing damage to any property involved in service delivery.
Ensuring timely arrival at designated service points.

Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations due to events beyond its control, including but not limited to:

Natural disasters
Government regulations or restrictions
War, terrorism, civil disturbances, or strikes
Unforeseen travel disruptions, road closures, or supplier failures
In such cases, no refunds or compensation will be provided.

Limitation Of Liability

The Company shall not be held liable for indirect, incidental, or consequential damages arising from the use of our services.
The Company’s liability is strictly limited to the amount paid for the specific service.
Clients are advised to obtain appropriate insurance coverage for unforeseen events.

Third-Party Liability Disclaimer

The Company may work with external suppliers or service providers to fulfill certain services.
The Company is not responsible or liable for any errors, delays, damages, or misconduct caused by third parties.
Any disputes or claims regarding third-party services must be handled directly with the respective service provider.

Intellectual Property

All content provided by XALTED Exclusive Experiences, including but not limited to text, images, logos, and marketing materials, remains the exclusive property of the Company.
Clients are not permitted to copy, distribute, modify, or use any intellectual property belonging to XALTED without prior written consent.
Unauthorized use may result in legal action.

Indemnification

The Client agrees to indemnify, defend, and hold harmless XALTED Exclusive Experiences, its employees, and affiliates from any claims, losses, damages, or legal costs arising from:

Misuse of services
Violation of these Terms & Conditions
Any third-party claims related to the Client’s actions while using XALTED’s services

Warranties & Guarantees

All services are provided "as is" and without warranties of any kind, either express or implied.
The Company does not guarantee specific outcomes or results from using its services.
The Company shall not be held responsible for unmet expectations that were not explicitly agreed upon in writing.

Confidentiality

The Company respects client privacy and agrees to keep all client information confidential, except where disclosure is required by law.
Clients agree not to disclose any proprietary or confidential information received from XALTED to third parties without written consent.

Privacy & Data Protection

All personal data collected will be used solely for service delivery and communication purposes.
The Company does not share or sell client data to third parties without explicit consent.
Payments are securely processed by Xendit, and the Company does not store any credit card information.

Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of Indonesia.
Any disputes arising from these terms shall be resolved through negotiation or mediation. If no resolution is reached, the matter shall be settled in an Indonesian court.

Amendments

The Company reserves the right to amend these terms at any time.
Clients will be notified of significant changes via email or website updates.
